One of DeCotiis, Fitzpatrick, Cole & Giblin, LLP’s newest partners, Mark J. Semeraro, successfully secured another victory at the Appellate Division in the defense of employment liability claims, as they pertain to the New Jersey Law Against Discrimination (NJLAD). Mr. Semeraro represented a wholly-owned, government-funded nursing facility in a discrimination claim filed by a former employee. Despite the fact that the employee applied for retirement benefits several months prior to the day she separated employment, and despite the fact that upon her exit interview, she signed an acknowledgment that the reason for her separation was retirement, she instituted a lawsuit alleging discrimination. Mr. Semeraro filed a motion for summary judgment based upon the fact that the lawsuit was filed outside the two-year statute of limitation under the NJLAD and because there was no material issue of fact and no evidence of any discriminatory intent or act taken by her employer. The Trial Court granted relief based upon both grounds and the Appellate Division affirmed it.
